Middlesex County Premises Liability

When property owners in Middlesex County fail to make sure their property is free of any hazards, someone can get hurt. Most of the time, property owners make sure there is nothing dangerous and keep their property safe. However, when an owner is negligent, they may be held legally and financially responsible for any injuries that may take place as a result of their negligence.
If an individual does become injured on another person’s property and wishes to bring a lawsuit, he or she will have to prove that the property owner was negligent. They must fulfill the burden of proof, which means that they are required to show that the property owner knew or should have reasonably known that the hazard existed on the property and failed to remedy it. For example, if a property owner knew that their walkway was very icy but failed to put salt down to melt the ice and someone slips and falls, they may be held responsible under premises liability.
Some property hazards that are often the cause of injury include:

  • Building code violations
  • Dangerous substances
  • Weather conditions such as snow or ice
  • Animals not kept behind a fence
